Terms & Conditions

1. Definitions                                                                                                                                                          

1. “The Dealer”, the person who is the vendor of the goods to the customer.                                                                

2. “The Customer”, the person contracting for goods and services to be supplied by the Dealer.                                                     

3. “Consumer”, a Customer, being an individual who, for the purposes of the purchase, is acting wholly or mainly outside of their trade,

     business, craft or profession.                                                                                                                                                              

4. “Goods” means all vehicles as defined or other things to be sold by the Dealer to the Customer.                                                 

5. “Vehicle” includes any car, lorry, van, trailer, caravan, invalid carriage, motor cycle and generally each and every accessory to and     

      component thereof.  

                                                                                                                                               

2. Whole Contract                                                                                                                                                   

1. These terms shall represent the whole contract between the Dealer and the Customer and represent a binding sale.                   

2. They may be varied only by written agreement between the parties.                                                                                                                                                        

3. Interpretation                                                                                                                                                     

1. The singular shall include the plural and the male shall include the female or business entity as may be appropriate.                                                                                                                                                    

4. Enforceability                                                                                                                                                      

1. In the event of any one or more of these terms and conditions being declared unenforceable, the remaining terms and conditions shall

    nonetheless remain in full effect. If by purchasing the vehicle it is believed the customer is in acceptance of all these terms stated in

    this whole agreement.

                                                                                                                                               

5. 5. Used Goods                                                                                                                                                      

1. If the goods to be supplied by the Dealer are used, the vehicle is supplied as roadworthy at the date of delivery and, in the case of

    consumer sales (as defined by the Sale of Goods Legislation):                                                                                  

1. Is sold subject to any conditions or warranties that are implied by the Sale of Goods Legislation or any amending statutes.           

2. Prior to paying for the goods the Customer shall examine the Vehicle and the purchaser is reminded that the conditions of satisfactory

    quality and fitness for purpose implied by the Sale of Goods Legislation do not operate in relation to such defects which the examination

    ought to reveal. Should the Goods be sold also subject to defects notified by the Seller to the Customer before signing the agreement,

    the implied conditions of satisfactory quality and fitness for purpose do not operate in relation to those defects.          

2. Save in the case of customer sales (as defined) all statements, conditions, or warranties as to the quality of the Goods or their fitness for

    any purpose whether express or implied by law or otherwise, are hereby expressly excluded.                                                        

3. Any manufacturer warranties shall automatically transfer over to the customer. Any variation agreed between the Dealer and the Customer

    regarding the Goods to be supplied shall be deemed to be an amendment to this Contract and shall not constitute a new contract. Any

    amendments shall be in writing via email or letter.                                                                                                                                                 

6. Retention of Title and Risk                                                                                                                                    

1. Risk of damage to or losses of the Goods are at the risk of the Customer as soon as they are delivered/collected into the physical possession

    of the Customer or their nominated representative.                                                                                                            

2. It is the customers duty to make sure they have the correct level of insurance cover before they take possession of the vehicle. We do not

    provide any insurance once the customer takes physical possession of the vehicle and we will not be held liable for any claims made against

    the vehicle once the customer takes possession.                                                                                                                                              

7. Payment                                                                                                                                                              

1. The Customer shall be liable to pay for the Goods immediately upon notification by the Dealer that they are available for delivery/collection.

     The Dealer may, in its discretion, demand a deposit at the time when the order for Goods is placed by the Customer and shall not be obliged

     to progress the order or otherwise implement the contract until the deposit is paid in full. The dealer shall furnish the customer with a paid

     receipt within 7 days of the full payment being received for the goods. Any outstanding balances for goods are to be paid within 7 days of

     delivery. Thereafter they may incur a fine of £25 after every 7-day cycle.                                                                                                                                                

8. Place of Delivery                                                                                                                                                  

1. Unless otherwise agreed in writing delivery of the Goods shall take place at the Dealer’s premises.                                                                                                                                                             

9. Part Exchange                                                                                                                                                      

1. Where the Dealer agrees to allow part of the price of the Goods to be discharged by the customer delivering a used Vehicle in part exchange

    to the Dealer, in consideration of such allowance, it is hereby agreed that the following further conditions will apply.

1. that the Dealer accepts the used vehicle in reliance of the warranties granted by the Customer overleaf, including but not limited to the age,

    mileage and condition of the vehicle.                                                                                                                                           

2. that such used Vehicle is the absolute property of the Customer and is free from all encumbrances. OR                                      

3. that such used vehicle is the subject of a hire purchase or agreement or other encumbrance capable of cash settlement by the Dealer, in

    which case the allowance shall be reduced by the amount required to be paid by the Dealer in settlement thereof.               

2. If the Dealer has examined the said used vehicle prior to his confirmation and acceptance of this order, the used vehicle shall be delivered

    to them in the same condition at the date of such examination (fair wear and tear excepted).                                             

3. That such used Vehicle shall be delivered to the Dealer on or before delivery of the Goods to be supplied by them hereunder, and the

    property in the said used Vehicle shall thereupon pass to the Dealer absolutely.                                                                                              

4. That without prejudice to above, such used vehicle shall be delivered to the Dealer within 14 days of notification to the customer that the

    Goods to be supplied by the Dealer are available for delivery.                                                                                                     

5. If the goods to be delivered by the Dealer, through no default on the part of the Dealer, shall not be delivered to the Customer within 30 days

    after the date of this order or the estimated delivery date; where that is later, the allowance on the said used vehicle shall be subject to a

    reduction by an amount not exceeding 2.5% for each completed period of 30 days from the date of the expiry of the first mentioned 30 days,

    to the date of delivery to the Customer of the Goods.                                                                                               

6. In the event of the non-fulfilment of any of the foregoing conditions, other than above, the Dealer shall be  discharged from any obligations to

    accept the said used Vehicle or to make any allowance in respect thereof, and the Customer shall discharge in cash the full price of the

    Goods to be supplied by the Dealer.                                                                                                                                               

10. Authority to Contract                                                                                                                                         

1. Goods supplied by the order of any person in the Customer’s employment or by any person reasonably believed by the Dealer to be the

2. Customer’s agent or by any person to whom the Dealer is entitled to make delivery of the vehicle shall be paid for by the Customer.                                                                                                                                                   

11. Distance Selling                                                                                                                                                 

1. If, and only if, the Customer has acted as a Consumer, where this Agreement has been completed away from our business premises and/or

    without any face to face contact between us and you; or anyone acting on your or our respective behalf, you may give notice to cancel this

    Agreement within 14 days without giving any reason.                                                                                              

2. This cancellation period will expire 14 days after the day on which you, or a third party on your behalf, takes delivery or otherwise acquires

    physical possession of the Goods. To exercise this right to cancel, you must inform us of your decision to cancel this Agreement in writing by

    clear statement e.g. a letter sent by post or email) to our address.                                                                                          

3. To meet the cancellation deadline, it is sufficient for you to send your communication confirming your exercise of the right to cancel before

    the cancellation period has expired.                                                                                                                

4. If you cancel this Agreement, we will reimburse to you all payments received from you under this Agreement, without undue delay, and

    not later than: –                                                                                                                                                               

1. 14 days after the day on which we receive the Goods back; or                                                                                                  

2. (if earlier) 14 days after the day you provide evidence that you have returned the Goods; or                                                      

3. if there were no Goods supplied, 14 days after the day on which we are informed about your decision to cancel this Agreement.  

5. We will make the reimbursement using the same means of payment as you have used for the initial transaction, unless you have expressly

    agreed otherwise, but in any event, you will not incur any fees as a result of the reimbursement.                                              

6. We may withhold reimbursement until we have received the Goods back. You should send back the Goods or deliver them back to us at

    the address stated on our website, without undue delay and in any event not later than 14 days after the day on which you communicate

    your cancellation of this Agreement to us.                                                                                                                                               

7. This deadline is met if you send back the Goods before the period of 14 days has expired. We will require that you bear the cost of returning

     the Goods to us.                                                                                                                                                               

8. You must take reasonable care of the Goods whilst they are in your possession. You will be responsible for any loss or damage from when

     they are delivered to you until when they are returned to us.                                                                     

9. You are liable for any diminished value of the Goods resulting from the handling other than what is necessary to establish the nature,

    characteristics and functioning of the Goods as well as any depreciation due to an increase in mileage. This mileage depreciation will be

    calculated accordingly and deducted from the reimbursement amount.                                                                                                                                                     

12. Storage                                                                                                                                                              

1. The Dealer reserves the right to make a reasonable daily charge for the storage of the customer’s vehicle or vehicles.                                                                                                                                                  

13. Dispute                                                                                                                                                             

1. Where your complaint cannot be resolved, once you have exhausted our internal process you may refer the dispute to the          

2. following ADR processes,                                                                                                                                                      

1. where your complaint does not relate to a financial service, the National Conciliation Service.                                                    

2. where your complaint relates to Financial Services, the Financial Ombudsman Service. This service is free to use. Their consumer helpline is

    available on 0800 023 4 567 or 0300 123 9 123 or you can visit their website at www.financial-ombudsman.org.uk, email them at

    complaint.info@financial-ombudsman.org.uk or write to the Financial Ombudsman Service, Exchange Tower, London E14 9SR.              

3. Where any dispute cannot be resolved through ADR, this Purchase Order and Contract shall be governed by and construed in accordance

    with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts.             

Vehicle Purchasing

  1. Sell Your Car:

    1. To sell your Car to us, you must:

    2. be the registered keeper of the Car for at least 3 months;

    3. provide any information and documents about the Car to us when we reasonably request them;

    4. have at least 2 weeks of valid MOT left on your Car from the date you hand over your Car to us (unless other agreements regarding the MOT have been made in writing);

    5. ensure that the Car is not subject to any third-party rights (for example, joint ownership, or other loans secured against the Car); this excludes any outstanding finance on the Car that we have accepted; and

    6. be selling the Car as a consumer only (and not in any business capacity).

  2. Finance:

    1. If you wish to sell your Car with outstanding finance you must:

    2. declare this to us when providing details of your Car;

    3. provide accurate information about your finance provider and the settlement figure; and

    4. you must have a valid settlement letter from your finance provider that is valid for not less than 7 days after the date of Pickup or Drop Off of your Car.

    5. We may reject your Car if it still has outstanding finance, for any reason, including if:

    6. it is an electric car and there is outstanding finance on the battery; or

    7. the amount of outstanding finance exceeds our valuation of your Car. (Unless prior arrangements have been made to settle the remaining balance).

    8. We don’t have existing relationships with all car finance providers. So, if your Car has outstanding finance, we might need your help contacting your finance provider to clear the outstanding finance on your Car, both before and after you hand over your Car to us. You agree to provide any information and assistance that we reasonably request to do this. If your finance provider refuses or otherwise fails to clear the outstanding finance on your Car, we may require you to make an additional cash payment equal to the outstanding finance amount on your Car. We will contact you if this happens.

  3. Valuation:

    1. You may use our Valuation service for personal, non-commercial purposes only. The Valuation is an estimate only, made using information you provide to us that we do not verify. You must not rely on the Valuation to make any financial or other decision.

    2. Each Valuation is valid for 14 days after the date of issue and will expire at 23:59 on the 14th day. If your Valuation expires and you still want to sell your Car to us, you must get a new Valuation.

    3. You can offer to sell your Car to us at the price set out in a valid Valuation. To do this, you must let us inspect the Car at Pickup or Drop Off (as applicable).

    4. We are not required to buy the Car from you, and any adjustment we make to the Valuation following inspection, is solely at our discretion. We will confirm the final purchase price to you after inspection.

    5. On or before inspection we may change any Valuation, or reject the Car, for any reason, including where:

    6. the Car does not match the description (whether as to specification or condition) you gave; or

    7. there is a discrepancy in the recorded mileage, legal registration, or chassis number of the Car; or

    8. the Car has been in a major accident or is categorised as insurance category A, B, N or S, or has been subject to a total loss claim; or

    9.              we identify any other issue in a car history check on the Car; or

    10. you do not have the right to sell the car (for example, because you are not the         registered keeper); or

    11. the Car’s V5 registration document is missing, incomplete or not in your name; or

    12. the Car is subject to any third-party rights (for example, because it still has a finance marker on it at the point of Pickup or Drop Off or the amount of outstanding finance at the point of Pickup or Drop Off if different from the amount you provided to us); or

    13. the Car is an imported vehicle or was not first registered in the UK; or

    14. the Car has been used for taxi, private hire, chauffeur, or rental purposes, driving tuition or as a police vehicle or used by a local authority; or

    15. the Car does not have a valid MOT (which must be valid for at least 14 days after the date you hand over your Car to us) or is due for a service in the next 100 miles;

    16. the Car’s tyres are not road legal; or

    17. the Car has any mechanical or electrical fault (including problems with steering, transmission, clutch, gearbox, suspension, or brakes); or

    18. the Car has been modified in any way; or

    19. Cazoo's decision is final on whether mileage is materially different from that provided in your Booking. Any mileage difference greater than 1,000 miles is automatically deemed materially different for this purpose.

  1. Handover:

    1. When you hand over the Car to us, you must give us:

    2. all sets of keys to the Car;

    3. the valid V5 registration documentation (which must be red) and, as applicable, any associated documentation (including any service books, and MOT certificates) for the Car; and

    4. any extras that a new owner might need (for example, the locking wheel nut for the alloy wheels and any security codes associated with the Car).

 

             If you don’t provide these items, we can’t buy the Car from you.

 

  1. You authorise us to transfer the Car’s registered keeper from you to JRD Automotive Ltd (or any other person we nominate) using the Car’s V5 documentation.

  2. Until Pickup or Drop Off happens, you are responsible for registering and paying for all vehicle tax and for all charges, fines, tolls, civil penalties and similar costs relating to the Car (including charges and civil penalties relating to parking, fines and fixed penalties for motoring offences, clamping release fees, towing fees, impound charges, toll road charges and penalties, congestion charges and other environmental charges) and any taxes or court costs related to them (together “Fines”). You must pay any Fines incurred before Pickup or Drop Off promptly.

  3. You agree to reimburse us in full and on request for any costs we incur in processing or disputing any Fines relating to the period before Pickup or Drop Off. We may charge you an administration fee of £20 for each Fine we process relating to the period before Pickup or Drop Off (as applicable). We may withhold an amount for any Fines or related administration fees from the amount we pay you for the Car.

  4. You must remove any personal belongings from the Car before Pickup or Drop Off. We will not be responsible for any personal belongings left in the Car following the handover of the Car.

  1. Payment:

    1. We will notify you after we inspect the Car (usually at Pickup or Drop Off) to confirm the Final Valuation and arrange payment to you.

    2. The Final Valuation includes VAT (where applicable) at the current rate chargeable in the United Kingdom on the date of sale.
